U.S. companies that do business outside the United States face increasing risks under the Foreign Corrupt Practices Act (FCPA). The Entertainment Industry is not immune from such problems. Companies involved in filming, financing, or other activities outside the United States may encounter corruption in a variety of situations, thereby exposing them to potential violations under the FCPA.

Such situations may include obtaining visas, permits, and locations for filming; shipping equipment overseas; hiring temporary employees on location; entering into co-production agreements with non-US production companies; obtaining foreign financing; acquiring production rights; obtaining broadcast and theater rights; and requesting local government cooperation against piracy.

Topics to be discussed by these Distinguished Speakers will include:

• Review of DOJ and SEC actions affecting the entertainment industry.

• How are companies in the entertainment industry at particular risk, and how might these risks be minimized?

Appreciation is given to O’Melveny & Myers LLP for making available their recently published Sixth Edition “FCPA Handbook,” and to PricewaterhouseCoopers LLP for making available their recent thought leadership paper “Corruption Crackdown: How the FCPA is changing the way the world does business.”

*An application will be made in New York and California for 1.5 hours of MCLE credit. O’Melveny & Myers LLP is a State Bar of California MCLE provider.
