The dramatic upsurge in domestic securities litigation by the SEC, DOJ, state Attorneys General, investor class actions, and businesses against businesses presents an intense challenge for Directors and Top Management. Deep pockets, whether a public company, investment manager, hedge fund, private equity, or financial institution may be a defendant and may even sue each other. This surge in enforcement and litigation arises from unprecedented losses in securities markets; catastrophic problems of many financial institutions; subprime; and alleged fraud. This distinguished panel will analyze techniques of dealing with these unprecedented challenges.

In accordance with the requirements of the New York State Continuing Legal Education Board, this non-transitional continuing legal education program is not approved for the newly admitted attorney within the first two years of admission to the Bar. It has been approved for experienced attorneys for a maximum of 2.0 credit hours, of which 2.0 credit hours can be applied toward the areas of professional practice requirement.
