The False Claims Act provides for the government or individuals to file suit when a company knowingly makes a false claim for compensation from the government.  Any business that deals with the U.S. government needs to know the potential areas for false claims and best practices to avoid liability with fines and treble damages.  Investment in good compliance and financial controls for FCA can be valuable when invoicing even non-governmental clients.

These Distinguished Panelists will discuss recent issues involving the False Claims Act, how to proactively prevent false claims, and defense strategies.  The scope will include both federal and state false claims acts and is relevant to companies dealing with both the US and state governments.  Key points include:

  • Federal, state, and local governments are extremely important customers for many industries requiring careful billing procedures and internal compliance supervision implemented by Directors and C-Suites
  • Legal issues can arise both from government officials asserting that there is impropriety and from whistleblowers that bring it to the attention of the government
  • A major specialty practice has arisen among plaintiffs’ attorneys who represent whistleblowers for violations of federal, state and local regulations
